Terms of Service
These Terms govern access to and use of the PlanMyCrew contractor management platform operated by Tradesflow (Pty) Ltd trading as PlanMyCrew.
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the PlanMyCrew contractor management platform ("Service") operated by Tradesflow (Pty) Ltd trading as PlanMyCrew ("Company", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
These Terms constitute a legally binding agreement under the laws of the Republic of South Africa.
2. Description of Service
PlanMyCrew provides a cloud-based contractor management and workflow platform.
3. Eligibility
You must be at least 18 years old and have authority to bind your organisation.
4. Account Security
You agree to maintain confidentiality of login credentials.
5. Acceptable Use
You agree not to misuse the Service or upload unlawful content.
6. Customer Data
You retain ownership of all data uploaded to PlanMyCrew.
7. Data Protection and Privacy (POPIA)
PlanMyCrew processes personal information in accordance with POPIA and applicable South African laws.
8. Cross-Border Data Transfers
Data may be stored in South Africa, the European Union, or other secure regions.
9. European Union (GDPR) Compliance
Where EU data subjects are involved, GDPR principles will apply.
10. Data Security
PlanMyCrew implements encryption, access control, and monitoring.
11. Service Availability
Service availability is governed by the SLA in clause 12.
12. Service Level Agreement (SLA)
PlanMyCrew provides 99% monthly uptime excluding maintenance windows between 22:00 and 24:00 SAST.
13. Subscription and Fees
Fees are billed monthly or annually and are payable in advance. Fees are non-refundable.
14. Term, Trial Period and Termination
A free 30-day trial may be offered.
Customers may cancel with one (1) calendar month written notice to [email protected].
Access continues during notice period.
15. Limitation of Liability
Total liability is limited to fees paid in the preceding three (3) months.
16. Indemnity
You agree to indemnify PlanMyCrew against claims arising from your use.
17. Third Party Services
PlanMyCrew is not responsible for third-party integrations.
18. Modifications
We may update these Terms at any time.
19. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
